Stimulus check update: Deceased individuals receiving checks

The Internal Revenue Service (IRS) has already sent out nearly 90 million checks containing stimulus funds which represents funds for over half of the eligible amount of people.

But in the haste to get these checks out, it seems like there have been some mishaps.

There are many reports out there of stimulus checks being sent out to deceased individuals.

Some people who have recently deceased but still have bank accounts have apparently had funds from stimulus checks deposited into their bank accounts and the funds have been subsequently discovered by family members.

For example, Katy Dobbs of Raleigh said her deceased father’s bank account, had $1,200 dollars in stimulus funds show up unexpectedly and they are not sure what to do.

The IRS is stating to give the money back as deceased individuals were not intended to receive funds (the same thing happened last time that stimulus funds went out during the Great Recession).

Remember, checks are going out to people who filed in 2018 and 2019 and so it makes sense that many of those people are no longer with us a couple of years later.

But here’s what we don’t know though.

We don’t know exactly how those funds should be sent back and what exactly will happen if somebody decides to keep them.

Will the individual responsible for the bank account be liable to the IRS for that amount?

Some tax experts don’t believe that the IRS has authority to clawback these stimulus checks if they were erroneously sent out to deceased people.

Currently, there is a provision in the CARES Act which states that if the IRS erroneously sent you more stimulus funds than you are owed, you are not required to send those back.

As reported by MarketWatch, “An important provision of the [Coronavirus Aid, Relief, and Economic Security] act, as it relates to these checks, is that if the IRS sends you too much money, you do not need to pay it back. It is considered a clerical or math error on behalf of the IRS.”

This was made in an effort so that the funds could be delivered as efficiently as possible.

So I think people who want to hold onto the funds and keep them may have a legal argument for why they should NOT be required to hand over those funds.

In the meantime, many people will likely be frustrated because they have not received their funds while deceased individuals have.

We are also awaiting more details about a possible second stimulus. It sounds like the President is not favoring that option though and as the economy begins to open back up, a second stimulus may become less of a reality.

  1. I received my 1200 but didn’t get any for my two children I am on SSI and don’t have to file taxes how am I going to be able to get the money for them from the IRS EIP

    1. I rereceived 12,oo But did Not received any for SSI payments am on SSI too so do I still get payment for that too ?

Im on ssi and i have direct express card and i still don’t see my stimulus money and i have my income tax on February 3 2020 with my neches federal credit union bank account still nothing in either one.My husband gets ssi and social security he have direct express card he still didn’t get his either.And when check the status on the irs get my tool payment it says try again in 24 hour.

  2. ALOT OF US HAVE BEEN WAITING FOR ARE STIMULUS CHECKS AND WE ARE A GROUP OF SSI AND ALOT OF OTHERS HAVE GOTTON THERE PAYMENT ALREADY WHY HAS IRS NOT SENT THEM TO ARE PRE-PAID NETSPEND ACCOUNTS AS OF YET IN STEAD ALOT OF US IS STILL WAITING AND STILL GETTING AN NOT AVAILABLE MESSAGE.

    1. I’m non. Soial Secrity Disability I have direct deposit for that my taxes I had done at HR Block. my returns for 2019 was put on a debate card. I made less than 30,000 and no stimulus. I my information needed on get my stimulus I always get your info doesn’t match are records what going on?

  3. I am on Social Security Disability and have my checks fo on my DIRECT EXPRESS CARD.
    I still have not gotten my money and it seems everyone i know has gotten theres.
    Do I need to do anything? How do i find out what is going on? I can never find a straight answer

    1. I got my stimulus checkvas if I am on social security and my daughter is on ssi but did not get her payment yet and she also has a bank account why did she not get hers

  4. I am on social security and have only received my social security payment and still no stimolus check i have waited and was told by May first well here it is and no payment what gives I have direct deposit

  5. So when checking if my payment is going to be deposited i checked the my payment portal and put my info. In it said that my payment would be in on April 30th 2020. Since then im still waiting for my payment till today May 1st 2020 please help. Thanks in advance Christen

  6. Ok, I filed an income tax for 2018 and 2019, I received my stimulus check, but I have a son that gets SSI, would my son get a check or not?

  7. I haven’t received my stimulus check but the irs portal says it was deposited on April 29 2020. I am disabled and get direct express on a card and the account it was deposited in Is an account that doesn’t belong to me. I called the bank and they said they show no money has been deposited in any account of mine. I did get my normal monthly amount two days sooner than normal. Help me find where my 1200$ stimulus check is. [email protected]
